<P>Another issue that makes mediation difficult at small 
claims court is when the defense&nbsp;claims&nbsp; "lack of standingto 
sue".&nbsp; Fundamentally there has to be a legal link between the plaintiff and 
the charged defendant for the plaintiff to sue.&nbsp; Take for example, a 
contract dispute&nbsp;with claims for damages.&nbsp; If the plaintiff is not 
part of the contract in any legal sense then plaintiff can't sue unless a legal 
interest&nbsp;was some how created by, for example, assignment of rights to that 
contract.&nbsp; I can't do much in these situations&nbsp;because a 
defendant&nbsp;knows the best the plaintiff will get, is a dismissal without 
prejudice.&nbsp;</P>
